1. Legal Definition: What is Consular Legalization

Consular Legalization (Nitikorn) is the process by which the Department of Consular Affairs, Ministry of Foreign Affairs, certifies the authenticity of the signature and seal of the certifying official on a document, enabling Thai-issued documents to be legally valid abroad. Per Section 3 of the Public Documents Act B.E. 2540 (1997) and the Consular Affairs Department Regulation B.E. 2563 (2020), legalization does not certify document content but rather the "Chain of Authentication" of signatories.

2. Thailand's Apostille transition

Thailand acceded on 30 June 2026, and the Convention enters into force for Thailand on 28 February 2027. Thailand does not issue Apostilles before that date. After entry into force, users must still check the competent authority, eligible document type and Convention relationship with the destination.

3. Four-Tier Legal Chain of Authentication

Thai consular legalization follows a 4-tier legal structure that cannot be skipped. Tier 1: translation by a qualified translator (MOJ-registered or Translators Association-registered). Tier 2: certification of the translator's signature by a Notary Public registered with the Lawyers Council (per the Lawyers Council Regulation on Notarial Services B.E. 2551). Tier 3: certification of the Notary's signature by the Department of Consular Affairs, MFA. Tier 4: certification of the Consular Department's seal by the destination country's embassy.

4. Information required for route checking

Send every page, the destination country and authority, purpose, required date and any recipient instructions. Staff separate translation, signature certification, MFA and mission steps before issuing a quotation.

5. Fees and schedules

Official fees, filing hours and appointment channels can change. Check the current MFA notice when preparing to file. Company charges are not displayed online; a written quotation identifies them separately from official fees.

6. Originals and personal data

Before sending originals, confirm the recipient, address, tracking method and documents genuinely required. Irrelevant data may be masked in assessment copies where this does not prevent review. Document retention and return should be stated in the engagement scope.

What to know before sending documents for consular legalisation

Consular legalisation by the Department of Consular Affairs confirms the signature and seal of the Thai signing authority — not the content of the document. Foreign recipients therefore often require a further step at their own embassy in Thailand. Understanding this sequence helps you estimate time and official fees correctly.

Some documents must be translated before legalisation, some need a notarised signature first, and some — such as foreign-issued documents — are outside the Department’s scope. Sending a scan for staff to check before travelling avoids a wasted trip.

What consular legalisation is

Legalisation is the process by which the Department of Consular Affairs, Ministry of Foreign Affairs, verifies and stamps the signature and seal of the person who signed a document — whether a government official or a Notarial Services Attorney. It is the intermediate step between the source document and attestation at the destination country's embassy.

Legalisation does not certify the document's content; it confirms the chain of signatures and seals. A document with wrong content or a faulty translation is not cured by legalisation, so the document must be correct from the source.

Which documents can be legalised

Thai official documents — birth certificates, marriage certificates, company affidavits and criminal record checks — can be legalised directly. Private documents such as contracts or powers of attorney must first be signed before a Notarial Services Attorney before entering the legalisation chain.

Educational documents for some countries must first be certified by the Ministry of Education or the issuing institution. Checking the specific route for each document type before filing avoids rejection.

Process and timing

The standard sequence is: prepare the original, translate if needed, legalise at the Department of Consular Affairs, then attest at the destination embassy in Bangkok. Each step has its own fee and processing time; together they typically take from several working days to a few weeks, depending on the embassy's queue.

What the Apostille will change

Thailand acceded to the Apostille Convention on 30 June 2026, and it enters into force on 28 February 2027. After that, documents between Thailand and member states will use a single Apostille instead of the multi-step chain, while non-member states still require legalisation and embassy attestation as before.

During the transition, check the destination country's status on the HCCH website every time, because choosing the wrong route leads to rejection at the destination.
